Terms and Conditions

1. Contracting Party
These terms and conditions apply if you choose to take up a subscription to frieze. Please read them carefully as they affect your rights and liabilities under the law and set out the terms under which Frieze Publishing Ltd., (“we” or “us”) make subscriptions available to you.
2. Ordering your subscription or ordering on-line
Your subscription entitles you to receive copies of frieze. Published eight times a year, you can order your subscription at any time.
3. When is the contract formed on-line?
When you click “Submit” to submit your Subscription, back issues, or publications order on-line, you are making an offer to take out a subscription to frieze magazine or ordering back issues or publications which, if accepted by us, will result in a binding contract between us. When you have completed the on-line form, and choose to pay by Secpay online, clicking the «Submit» button will start the payment process. Once the credit card company has authorised payment, your account will be debited and you will receive an e-mail confirming your Subscription or order. However, we will not be responsible if you fail to receive the written confirmation in the event there is any type of disruption with the e-mail services subscribed to by you, your e-mail address is incorrect or other dysfunction related to the network. We reserve the right not to accept or process your order for any reason. All orders are subject to validation checks and authorisation by your payment card issuer.
4. When is the contract formed ordering off-line?
Your subscription contract is active upon receipt of your confirmation letter from us, which will be sent within 10 working days of receipt of payment. We will not be responsible if you fail to receive this written confirmation because you have supplied us with an incorrect, or incomplete, postal address. Your subscription and online access is personal to you and non-transferable, except where you place an order in someone else’s name as a gift. In these circumstances you will have to pay the subscription fees as laid out below. 
We reserve the right to refuse to accept any application for a subscription for any reason including (but not limited to) the following:
* In the event of inaccuracies in price
* In the event that we are unable to obtain authorisation from the issuer of your payment card, or in the case of Direct Debits, from your bank.
We may use third parties to assist in the provision and fulfilment of any part of the subscription service on our behalf. We may pass your personal information provided by you to such third parties but only for the purposes of providing the subscription service to you.
5. Payment
We require payment in advance for all subscriptions, publications and back issues. If you are choosing to call with credit card details or to pay by cheque or send by post a Direct Debit mandate your order will be fulfilled upon receipt of remittance, or on publication, whichever is the later date.
6. Delivery
We will deliver the magazines to the address you notify to us when you place your order. Upon receipt of payment your subscription will be started with our next issue (unless a renewal or otherwise specified), which will be dispatched upon publication. Any relevant back issues requested with your subscription will be dispatched upon receipt of remittance, and all subsequent issues sent upon publication. We will not be responsible if you fail to receive any issues because you have provided us with an incomplete or incorrect address. In order to avoid such mishaps, please notify us in the event your address changes. You can do this on-line using the form provided for this purpose by means of the access codes received with the confirmation of your Subscription or order for back issues.
7. Delay in delivery and non-delivery
We will not be responsible for delayed or non-delivery where the issuer of your card refuses to authorise payment, or your bank refuses to accept our Direct Debit mandate. Or where failure is due to circumstances beyond our control or the control of our sub-contractors. We are not responsible for any delay caused by customs, or liable for any import duties and taxes, which are levied after once the package reaches a specific destination. Any additional charges for customs clearance must be bourne by you. We have no control over these charges and cannot predict what they might be. We reserve the right to dispose of incorrectly addressed envelopes and their contents without an obligation to refund you or any other person if they are returned to us and if, despite efforts to contact you, we do not receive correct address details.
8. Renewals
If you pay for your subscription by Direct Debit there is no need to renew your subscription as it will continue until you cancel your Direct Debit and we will take payment every year. You will continue to receive issues of frieze until you cancel your Direct Debit. If you have paid by card or cheque, we will remind you that your subscription is due to expire before it does. The different renewal options and prices will be given on the renewal notice so you can choose whether or not to proceed with the renewal.
9. Cancellations and refunds
Where a minimum term is advertised cancellations are not permitted until the end of this initial period and we will not issue a refund. For all other subscriptions you may cancel your subscription at any time by notifying our customer services in writing, or by phone. We will refund you the cost of issues not yet issued to you at the time of your notification of your desire to cancel.
If you decide to return any publications, tote bags or our Ally Capellino x frieze rucksack all items must reach us in their original state within 14 days (UK) or 28 days (international) for a refund. Please include details of your order reference number in the parcel and return by tracked post to:

Make sure you obtain 'proof of purchase' which you should retain until you've received your refund.
Once we've received your returned item(s) we will send you an email to confirm your refund, which will be processed within 5-10 working days of receipt. You can expect your refund to reach your account within 3-5 working days. If after 10 working days you have not received an email from us, please call on +44 20 3372 6102 or email subscriptions@frieze.com with your returns details.
Please note that all card refunds will be issued in sterling to the card used to make the purchase. Your credit card company will convert (if appropriate) into your local currency and may charge an additional fee for completing the transaction. 10. Price Information
Prices displayed on the subscriptions section of the website will prevail at all times in relation to orders placed online. Prices quoted can be changed at any time at our discretion. Prices quoted include delivery charges. Subscriptions are not liable to VAT in the UK. You either make a one-off payment for a one or two-year subscription, back issues, or publications or make an ongoing direct debit for annual collection. If you make ongoing Direct Debit payments we reserve the right to increase our prices at any time after the first year of your subscription has elapsed and will notify you in writing with 10 days notice of any such price increase. Although we try to ensure that all prices are correct, errors may occur. If we discover an error in the price of your order, or an inconsistency between the rate for your delivery region and price paid, we will inform you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. We will refund you in full if you cancel the order and have already paid.
11. Credit Card Payment
If you are under 18 or are not using your own credit / debit card to pay for the subscription you must ask the permission of the card holder before entering payment details. By clicking “submit” you are confirming that you have obtained the express prior permission of the card holder.
12. Liability
Our liability to you in the event of magazines being lost in dispatch shall be limited to the replacement of missing issues. Any requests for a refund for missing issues shall be considered on a case-by-case basis at our discretion.
13. Use of Personal Information
We use the personal and transactional information you supply to us in order to fulfil your order. Unless caused by fraud or negligence on behalf of our staff we do not accept any liability for any misuse of your information (in particular your card details) by any other person.
Gift Subscriptions
A letter will be sent to the recipient informing them of the gift and letting them know who has subscribed on their behalf.
15. Subscription rates in $ and €Euro
The prices quoted in $ and Euro €on any marketing materials are approximate figures. All credit cards will be debited in Pounds Sterling by your bank or building society on behalf of Frieze Publishing Ltd., at the rate of exchange given on xe.com at the time of processing. Your bank or building society may apply a different exchange rate to that applied by Frieze Publishing Ltd., to convert the Pounds Sterling into your local currency and / or charge an additional fee for the transaction. 16. Subscription Term
If the magazine ordered changes frequency per annum, we will honour the number of issues paid for, not the term of the subscription.

The commercial re-use and reproduction of texts and photographs of the magazine and internet presentation is prohibited.
We may update these terms and conditions from time to time for legal or regulatory reasons or to allow the proper operation of our subscription service. Any changes will be notified to you so you can choose whether to cancel your subscription or whether to proceed with your next renewal.
If you do not wish to accept these terms and conditions you should not continue to subscribe as this will indicate your agreement to be bound by the terms and conditions.
